BATON ROUGE — The State Senate unanimously gave final passage a bill Thursday that would increase penalties for owners of dogs that attack and kill someone.

The bill — HB 213 — passed 36-0 in the Senate after the House of Representatives passed the bill 102-0 in April. The bill will not become law until the governor signs it.

Rep. Stephanie Hilferty, R-Metairie, authored the bill. If signed into law, the bill would increase the penalty to 10 years from five years for negligent homicide for owners of dogs that kill someone. Those convicted with negligent homicide under the new bill could also face a $5,000 fine.

Why does it center on "attack and kill someone"? There is a whole hell of a lot of suffering between an attack that is a nip and one that results in death. Ask the 70-something year old man in Texas (I think) who lost both of his legs due to a mauling by a German Shepherd and a pitbull.

I’d imagine most owners of violent dog breeds don’t have their pet registered and there’s little way to prove who the owner is.

If a possible 5 years in prison didn't scare a pit bull owner, what makes them think upping the penalty to 10 will? Maybe if they actually enforced the 5 year penalty people would reconsider.

Fine. I love dogs, but not vicious ones and not pitt bulls. But, the question I have is how many people were penalized under the old statute even when the sentence wsy 5 years? I have never heard of anyone.
