Assuming you are referring to SS disability. There are three steps:
1. Initial Claim - medical records are gathered and possibly consultative exams are set ups. A doctor, employed by the state, makes a decision. 70% are denied at this stage and a decision takes 4-8 months.
2. Reconsideration stage - A different doctor reviews the initial claim and makes a new decision. 99% of the time the initial decision is upheld (unless there is new medical). Takes 2-3 months.
3. Hearing - most people get approved here, this is the stage you want to consult with an authorized rep. Most reps don't do much, 1 out of 5 are actually helpful. Ask people in your local area who they used, the rep takes a % of the back pay up to $6k (they can file a fee petition for more). Don't use someone who advertises heavily, they are going on a volume game. A decision takes 1 - 1 1/2 years.
Have her open a myssa account and start her claim online. She can not be working at all.
