The problem outlined in the article results from people (the girl's friends and the administration) putting the reputation of the institution above the needs of the individuals hurt.
I would suggest Emily Renda's piece in the Cavalier Daily - it outlines why it's so difficult to convict someone.

When caught between demands of due process and Title IX, schools like U.Va. are forced to make procedural and disciplinary decisions that they hope will stand on appeal.

I agree that's a very good article.
However, it doesn't change my point; in fact, it affirms it.
First of all, a lot of good things can come from immediately reporting the rape, even if a conviction isn't in the cards. The woman can get counselling, evidence can be obtained, etc. To have her "friends" talk about their social viability over her immediate needs has obviously stuck with her a long time. In other words, she has no friends. That would and did linger with her for a long time.
Additionally, had she reported immediately, the evidence collected could have helped the case toward a more successful conclusion. Sure, the rapists may not have gone to jail, but they may have been expelled or otherwise sanctioned.
I do agree with her that Title IX is a hinderance to justice here. These cases are being dealt with by people who do not have the expertise or the authority to deal with them. That's a real problem, and UVA can only change how it complies, not the law itself.
Ms Renda states:
quote:If that is true, and I have no reason to say it's not, then it is a major indictment of the law as it stands today. And I think Ms Renda would agree, based on her comments throughout the rest of the article.
The University is — and I do not exaggerate — an outstanding institution in terms of our degree of conformity with the stipulations of Title IX and the letter of our policy.
I wouldn't want to completely cut the university out of these issues, but they do need to be more deferential to the authorities who can really do something about the issue.
Peace.
