You are taking this totally out of context and you do not understand that he’s discussing this in the context of constitutional law. As Justice Thomas once noted in a dissent, law banning sodomy may be a stupid law, but it’s not an unconstitutional law.

In the context of him writing
against the Supreme Court ruling in Lawrence v. Texas, which made it illegal for states to criminalize homosexual sex between consenting adults.
Johnson added
“Homosexual relationships are inherently unnatural and, the studies clearly show, are ultimately harmful and costly for everyone,”

Of course it's not unconstitutional.

But if you're on record as favoring the criminalization of homosexuality, you have zero chance of getting elected President of the United States.
