They are of course not going to decide Trump was operating in an official capacity.

They may not. They may send that back down to the trial court to decide, which may create a new avenue for appeal back to the USSC.

This depends on how much this exact issue was litigated at the trial court, unless they just go bonkers and violate their maxims and precedent.
