Does Pre-K tuition count as child care expenses on taxes?

Kid was in daycare for 4 years. Claimed the tuition on my taxes (helped a whole lot).
Now the kid is in Pre-K at a Catholic school that offers Pre-K.
Can the tuition be claimed like daycare was? Since Pre-K isn’t mandatory by the state?

It's a church school, at worst its a charitable donation. I put that stuff down as tuition for all 3 of my kids all the way through K.

Depends if you are referring to Federal or Louisiana.
Federal - Pre-K counts as eligible spending for child care credit / Dependent Care FSA. Kindergarten doesn't (but before/after school care would count).
LA - The LA school deduction starts with kindergarten.

There is no deduction for school tuition paid to a church school, because you are receiving value for the "donation".

You can set up a dcfsa with your employer and pay pre-k expenses.

Both parents need to be working or able to show why they couldn’t otherwise care for the child (such as a medical event).

Yes.
You can claim dependent care for tuition at K and older.
Pre K is not required by law. Hence its child care.

We made too much for it to help anyway, kids didn’t help us out at all for tax purposes

It’s a credit not a itemized deduction so yes

Not if it is at a catholic school as it’s considered tuition and not dependent care. I went through this when my son moved from pre-school to pre-K4. FSAs don’t allow payments to private schools, only day cares.
We were still far better off since pre-k4 tuition was far less than staying in day care.

My FSA has been reimbursing me for PreK “tuition” from my Catholic School.
Your issue might be related to reimbursement has to be in the same year you paid the tuition. I can’t claim FSADC for Jan-May 2020 schooling since I paid that in May 2019.

I don't think this is right. We've used it for private school pre-k and the FSA was set up through my wife's employer which was a private school.

Your link doesn’t say anything about religious schools being allowed. It says it can be used for day care or nursery schools though. I would imagine it would have to do with how the school is licensed.
My FSA specially would not allow religious schools I can assure you.

That's possible. Ours does allow for religious schools, but that doesn't mean yours does.

It sounds like the problem is with your FSA administration company, not the tax code and regs.
There is no legal distinction, for purposes of the credit / FSA eligibility, between a Pre-K run by a private company, or a religious organization, or a school that also has higher level grades.
The administrator might not understand what is happening here. Remember, in most parts of the country, pre-k students attend a nursery / primary school, not a catholic PreK - 7th grade school.

That’s not for the FSA Administrator to determine.
The issue likely comes from the FSA Admin unfamiliar with upfront tuition for the entire year of PreK. You can only request reimbursement for expenses paid in that calendar year and given that most PreK centers are month to month, its “confusing” when you’re submitting the same receipt for 5+ months.
