Is this an actual law? I’ve bought beer in dozens of places, and I’ve yet to have any business allow me to take my six pack or single out of the store without it being bagged. Buy a twelve pack or a case, no bag necessary. I can’t think of any practical reason for this. Is there one, or is it just more government stupidity?

Most places I go to in Atlanta ask, but like it's a courtesy

When I was a cashier at a grocery store in high school and college, we were told it was the law that six packs of cans and bottles had to be bagged. This was Alabama in the late 80's and early 90's.

In Louisiana I’ve picked my beer up to leave, and the cashier has stopped me, saying, “Hold on, I have to put that in a bag.”

At least you’re not in California where they charge you $1 for the bag and $1 to throw it away.

In NYC, you're allowed to drink out of a brown paper bag.
I'll assume this has no bearing on you're situation, but I thought it was interesting.

Store clerks often say it's the law, but I think sometimes a store policy is communicated or mis-communicated to them as being "the law."

If a poster knows of such a Louisiana statute or regulation, or a local law, please post a copy of or citation to the statute or regulation.

The question was recently asked in Illinois, and a lawyer said there was no such state law, and he could not find any Ill. city with one. That is meaningful there, because Chicago charges a 7 cent tax on bags (store gets 2 cents; city gets 5 cents).

From the Illinois column:

quote:

Question Why do stores make you put liquor purchases in a bag? Is there any law that requires it? Does it have anything to do with illegal transportation of alcohol?

Answer Stores may insist that all liquor sales be bagged, but no law requires it. “It’s the law” is a myth. A company policy might require bagging liquor sale-or everything-as proof of purchase. But it’s perfectly legal to exit a store brandishing a bottle of booze.

Do liquor purchases need to be in a bag?

I don't drink beer in traffic and I definitely don't with a cop around. And if I was drinking something with a brown bag around it, it wouldn't be anything but a beer because I don't put one around my bottle of water or coke, so this is a lame excuse

I researched it about 10 years ago because I thought it was the stupidest shite and a waste of money on bags...........never found a law and no one including store owners could give me an answer. First thing I do before it goes in my cup holder is lose the bag.

I thought it was a law when I lived in LA and MS.

Stores in Atlanta don't care. Seemed weird when I first got here.

All open container laws need to be abolished. It’s 2019 for Christ’s sake.

Revenue stream, baw. Where I live, a brewery has big windows that open to the outside. If a cop catches you leaning over with your beer outside of the physical building, they’ll give you a ticket.

I carry my 6 pack out of the store without a bag all the time in Texas. Well, all the time except before 11 AM on Sunday
