Have you ever personally known anyone who caused an accident as an uninsured motorist?

What, if any, accountability do they ever face? Seems like every other person is driving around, carefree, with no insurance these days while causing accidents.

Drunk driver illegal with no insurance. You have to do all the leg work if you want your car fixed and it has to go through your insurance. Fortunately, I went outside of insurance but i assure you it was a pain attempting it. I would hate to see what it would have been like to actually have to obtain the police report and try and file. PITA.

I was found at fault for an accident with an uninsured motorist when I was leaving a private parking lot.

The uninsured motorist::

1. Had his license plate removed from his vehicle by the Slidell police.

2. Could not file a claim against my insurance due to Louisiana's No Pay No Play law.

Although I had to pay my collision deductible and file against my own insurance, it made me happy that the other driver could not come after me AND he couldn't drive his vehicle home.

Not personally but there's this dude notorious for causing accidents of all kinds around my neighborhood. If you see him, let me know.

Here's what he looks like.

There’s a process by which they can be sued, a judgment taken against them for the value of the damages they caused, and then have their license suspended until they’ve paid off their debt.

This is exactly what's happening to the woman that hit me a few months ago. Rear ended me and pushed me into a truck in front of me, totaled out my car. Progressive got their legal staff on her quick.

Uninsured motorist coverage is a MUST in Louisiana now.

What happened from there though? That's what I'm wondering. I'm guessing most of these people are "judgment proof," so does the insurance company really go after them?

Absolutely. Last I heard they were going to get the court to garnish her wages until the debt is paid if she didn't go get a loan and pay them.

Nope, but I did get t-boned at a red light by a minivan. 5 Mexicans came out and ran in 5 different directions. No one left on scene when the cops got there. Van was owned by a painting company,

Similar situation, I was legit at fault and dented his front door going 5 mph. Was drinking, tossed the beer in the bushes and a person saw it. Cops showed up and talked me out of persuing his drinking, being uninsured (didn't matter really as my fault) and being an illegal. "Do you really want to take a whole day out of the office for this,Sir?" I let it go and we go on our way.

I called my insurance to get details when my rate went up and was told they paid the MF'r $10k for injuries. So pissed. Especially at that lazy arse cop.

How does this happen if the other person was uninsured? Was it in another state (besides LA)? It’s bullshite in any state, to be clear. I just don’t understand how the insurance company let it happen.

My nephew got hit in the parking lot of his college. They promised to pay him cash for the damage. I was skeptical, but they actually did.

Yes different state. INS company just didn't want to spend the time/money on fighting his sketch lawyer.

I was legit at fault so not sure it matters if he had insurance or not. Not sure if that is needed/matters in LA if you are the one being hit.

That makes sense (though it’s still completely shitty). Louisiana is a “pay to play” state. If we cause an at-fault wreck with an uninsured person, that person can’t recover damages from our insurance. There are some exceptions, but it prevents some bullshite like what you experienced. We still have the highest rates vs. income in the country, so I’m not sure how much good it’s doing.

Ahhh makes sense why you ask. Yeah that does sound like a better option.

:face-palm: y'all definitely have an array of stuff that will constantly counter any positives.

You can't have uninsured motorist property damage if you have full coverage (comprehensive and collision) in Louisiana. You can get UM bodily injury which will help if you or a passenger gets injured and needs to go to the hospital and covers lost wages as well. So still a good thing to have but that's not gonna cover his door.

I'm assuming he has full coverage so the door would need to be filed on his own insurance and be subject to whatever his collision deductible is. If he only has liability then he could have gotten and maybe has UMPD which has a $250 deductible.

Most people have a $500 collision deductible anyway so honestly the difference is usually "only" $250 between the two coverages. Yeah I know ideally you shouldn't have to pay anything for an accident that's not your fault but unfortunately that's the world we live in
