HOA orders child's sidewalk chalk art removed, now apologizes

Loser HOA crawfishes only after bad publicity gets out. The irony here is that the art said "Love your neighbor"

Kennedy last week spent the better part of an hour drawing “Love Your Neighbor” in front of the family’s home. “She was very proud of it,’’ her mother said. “Then we got the letter from the board.” That board was the Riverchase (Birmingham, AL suburb) Townhomes Owners Association, a subgroup of the larger Riverchase Residential Association. Seaton pays homeowners’ dues to both. “The Riverchase Residential Association has not been enforcing sidewalk chalk. They’ve been really good about fostering community during this time,’’ Seaton said. The RTOA, however, sent Seaton a formal letter Monday informing her that the chalk art was in violation of the covenants, calling Kennedy’s project “unsightly.” “The RTOA Board through enforcement of the RTOA covenants seeks to maintain the overall appearance of our neighborhood in order to protect all of our property values,’’ the letter stated. “We would very much appreciate it if you would clean up the sidewalk and refrain from using chalk or any other material to mar the sidewalks.” Seaton, who is an attorney, said she learned the board actually met as a group to discuss Kennedy’s “infraction” and move forward with the demand to have it removed. She called the president to discuss it with him but said he told her, “I can’t allow you to deface the property.” “They’re really digging their heels in,’’ Seaton said. “It’s disappointing.”

This is a prime example of an HOA just being a meddling POS organization. Get some power hungry, personality disordered people on there and all hell breaks loose. Did they not stop to think her sidewalk chalk would wash off after the first rain? Not like she painted gang signs on the side of the club house.

That took that kid a whole week to make? If sidewalk chalk was allowed in our neighborhood which it isn't (listed as a contraband substance under article 9 section 57 of the HOA contract) our kids better come up with a lot better art than that and not some bullshite message about loving your neighbor

Then maybe you should ask what your dues are going towards if they aren't actually enforcing any laws? If we saw some little shithead going to chalk a sidewalk in this neighborhood, you better believe she'd catch 3 pepperball (tm) riot paintballs before that graffiti maker could touch the sidewalk

I don’t understand how some HOAs can be so mind bogglingly retarded. Just use common sense. Your purpose is to maintain the common areas, landscaping, making sure lawns are mowed and no one parks a junk car in the yard. No one wants you harassing kids over chalk. It washes off in the rain. It’s not paint.
