Louisiana vape ban stalled by The Louisiana Convenience and Vape Store Association

A new law that was widely expected to ban flavored vape products in Louisiana this month has been stymied after a retailers’ association challenged the legislation in court.
The Louisiana Convenience and Vape Store Association filed a petition Tuesday for a temporary restraining order and permanent injunction of the law, which bans retailers from selling vape products not listed on a state-approved registry.
Filed in East Baton Rouge Parish, the lawsuit lists two state agencies and their top officials as defendants: Commissioner Ernest Legier and the Louisiana Office of Alcohol and Tobacco Control (ATC), and Secretary Kevin Richard of the Louisiana Department of Revenue.
In a statement, Legier promised to defend the law in court. He called the legislation a response to “a nationwide vape usage epidemic within the most vulnerable of our citizens—our youth.”
“The ATC intends to vigorously defend its obligation to protect Louisiana citizens and looks forward to a judicial decision rendered in its favor,” Legier said.
But vaping association argues “businesses will be irreparably harmed and may likely close if this legislation is not enjoined,” according to the lawsuit, a copy of which was provided by Legier’s office.

It’s quite odd that Juul and the other companies can’t sell flavored cartridge vapes (and they still sell the menthol and tobacco flavors at circle k) but there are hundreds if not thousands of smaller companies selling flavored disposable vapes in every sketchy gas station (the ones that actually would sell to an underaged kid) in america.
Either both kinds should be banned or none should.

If the members of the "Louisiana Convenience and Vape Store Association" would not sell to underage minors, we would not have an issue.
The number of middle school and high school kids with vapes tells me the retailers aren't even trying to enforce the age law.

But it's not. The chemicals that allow the vape product to vaporize are pretty awful for you. Popcorn lung is a real thing.
People who vape are not only inhaling an arse ton more nicotine, but they're also inhaling much more frequently than they would any tobacco product. They're all pretty bad for you.

Vaping has done more to get people off cigarettes than any other mitigation (nicotine gum, patches, etc.) out there.
bUt WhAt AbOuT tHe ChIlDrEn is normally a horrible reason for yet another law aimed at saving us from ourselves.

It's all bullshite. The law allows the sell of FDA approved vapes and cigarettes of course. All the FDA approved vapes are put out by the tobacco companies. Big tobacco wants their business back and obviously is greasing some palms to get it.

It’s because the law was written to punish Juul and not actually solve a problem.
The law bans flavored cartridges, but if it’s a single use or disposable device it’s fine.
Which is why the sketchy vape shops sell the “disposable” vapes the side of a cell phone with one huge unreliable cartridge

True, but is vaping actually any better for you? The stuff in those vapes is really bad.
At least tobacco is, somewhat, natural.

Those kids are either ordering the vape stuff online or getting them from the Discount Zone down the street. Lots of places sell vape products that aren't vape stores.
Just like when we would buy a pack of smokes when we were kids, it was at the local convenience store, not the Tinder Box in Lakeside mall.

Why stop at flavored vapes? Are they gonna ban flavored vodka and seltzers, etc next? Tired of government overreach.

What stuff? Most vape juices have three main ingredients: Nicotine, glycerin, and propylene glycol which is used in a number of food, cosmetic and pharmacy processes. Then add in whatever flavorings are needed.
