Selling a used boat out of state need assistance

Looking for some guidance (step by step) selling my used boat to a buyer in MS/AL (not sure if state matters)

My understanding is I can create a bill of sale for both boat and trailer separately? Then secure the funds, pay off remaining loan, and bank will send title of boat and trailer to buyer?

Does the bill of sale need to be notarized?

Any other steps? Cancel license plate with DMV?

Most of this is the buyers problem.

Since the bank holds the title for both, you need to call them and see how to handle it. Out of state vs in state is irrelevant to you. The buyer is likely going to want to pay the lien holder instead of you, at least I would.

Appreciate it. Bank was cool with a bill of sale it seemed. They didn’t seem to care as long as they get their money.

This reminds me of when I was at LSU, I had a guy from California coming to buy my 16' Dauntless. Dude drove with his wife and kids all the way to BR from California and ended up not buying it because I didn't have a title for the motor (which isn't required in Cali or Louisiana). I can only imagine how pleased his wife was the entire drive back home.

I sold a pontoon boat on eBay about 20 years ago to a soldier in Afghanistan. He bought it on a whim out of boredom. He contacted me and told me he had bought it on a whim and would not be able to come get it for 90 days until he rotated back home to Phoenix. The boat was in NE Georgia. I told him I would just re-list it and he wasn't obligated to buy it but he wanted it, just could not take delivery of it for 90 days. I told him not to worry about it, I would hold it until he could get it and if he did not buy it it wasn't a big deal I would just relist it. We agreed to this and thought this was the end of it.

At the time I had about $60K worth of commercial cabinet shop equipment on eBay and had sold about $35K of it in various stages of being delivered to the customers. About $30K of this had been paid through PayPal but had not been released because it was in transit. I received notification that my PayPal account had been frozen pending investigation of fraudulent activity. It turns out that my not shipping the pontoon boat to the buyer who had I had agreed could wait until he came back from down range to take delivery was the "fraud". Meanwhile the rest of that $60K worth of tools sold so I had $60k in my PayPal account I could not access and the $10K for the pontoon boat in "pending" status because I could not stop the sale because no attempt had been made to ship the boat LOL....to Afghanistan I supposed. Anyway the buyer submitted and affidavit prepared by the JAG on his FOB in Afghanistan that he was buying the boat in 90 days and would take delivery in 90 days. This was not good enough. The only way around this was for the buyer to submit the $10k to my frozen account and his brother drive from Phoenix to NE Georgia to take delivery of the boat. We had to have a notarized bill of sale that he had bought the boat and took delivery of it. It still took about 30 days to unfreeze my PayPal account. It was a mess.

This was my only experience with buying. I didn't want to pay the funds and have to wait for the title. Even paying the bank directly, I was going to have to wait for the cashier check to clear before the bank would release the title. And that took a few business days. Eventually had a co-worker who banked with the same bank the seller had the loan with and the funds cleared the same day. So I just paid my co-worker and technically he bought the boat for me, haha. Eased my mind as I could leave the parking lot with the boat on my truck and title in my hand.

Sold my boat to a guy from Ohio a few weeks ago. Had a mobile notary come to the house and handle all the paperwork, including the bills of sale. Can't help with the title part though, my boat was paid off and I had the title.

But yes, everything needs to be notarized and you will cancel the plate on the trailer once the sale is done .

Sold my 19' Boston Whaler Guardian to a guy on Facebook from Hawaii. Wired me the money. I drained the gas, drove it to Seabrook Marina in NOLA. Buyer had a company put it in a shipping container there, put on a semi and driven from NOLA to S.CA, and then put on a container ship bound for Hawaii.

Had both titles in hand. Had everything notarized and sold prior to dropping off at Seabrook so I was not responsible for shipping or safe transport across the Pacific.

Actually went very smoothly.

Buyer needs to figure out what his state requires. I have sold boats to people in Bama and Florida. Both only required bill of sale which did not need to be notarized. I would do separate bills of sale for the trailer and boat. Louisiana requires separate. I had to get manufacturer to redo for a boat I bought out of Florida. You will also need to cancel license plate at OMV and registration at LDWF.
