TN Enacts False DUI Reporting

Cops that make false DUI arrests must now report them to the state. A step in the right direction but it doesn't go far enough. A cop that wrongly arrests someone for DUI should be immediately fired and should have to pay all legals expenses that their victim incurred. These backwards hick cops refused to use breathalyzer tests because they just wanted to make arrests. Now after hundreds of false DUI arrests in TN, their actions are finally coming back to bite them in the arse. Breathalyzers should be mandatory for all departments. There is no legitimate excuse to not use them.

Well. It only took like 700 false DUI arrests in one year. And, for anyone seeing that number and not thinking it's that big. 700 was the number of ABSOLUTELY ZERO OF ANYTHING in their systems and doesn't include another metric frick ton who were nowhere near drunk but weren't .000.

The TN state police are little more than an organized gang. shite, they've been playing the civil asset forfeiture game in a way that would make Capone blush.

I watched a senior officer basically excuse it all because after all, in the end, if you weren't guilty, the blood test clears you.

That's a window in the soul of the police. They don't seem to think being kidnapped, tied up, thrown in a cage, then having to pay thousands to get it out is any big deal at all if at least you're cleared in the end!

But they take advantage of the situation with the auto-suspension if motorists do, sober or not. And blood test don't seem to be refusable.

Field sobriety tests are the heel to toe walk, HGN (follow my pen), and the one legged stand. You can refuse those without penalty in every state that i know of. Its the breath test at the jail that you cant refuse without getting your license suspended.

EVERYONE should refuse the FSTs as a matter of common sense. They are just circus tricks set up to make evidence against you.

Suspension only applies if you refuse a breathalyzer or the blood test

Ahhh ok. I was combining the 2. The more you know....

I guess it depends on other things for your lawyer to fight out, if you don't get your license suspended for refusing the breathalyzer. My thing is the obligatory blood test mass stops. Can't figure out how mandatory draws is Constitutional.

Ohh I definitely agree FSTs are circus "gotcha" tricks. Including to get you to say something like "I can't do that sober"..."gotcha"

Cops have the most sensitive noses. They can smell the strong odor of alcohol every time they stop someone.

Wut? How can someone be proven to be under the influence without one? On large holidays here for zero tolerance, they'll draw your blood w/ a court order if you refuse.

Strangely enough, this is a slippery slope. What happens when you've been pulled over and the cop goes straight for the breathalyzer when you've given no indication you're under the influence. You're put in a position of being suspected of a crime just for driving. They need probable cause to introduce the breathalyzer.

You should see the videos. The officers just claimed to be trained in detecting the signs and that's enough. As for non-alcohol arrests they also have officers who claim to be able to do that well enough to justify an arrest! It's fricking the police version of astrology. They might as well bring in a palm reader only in this case the palm reader has a positive stake in finding you guilty! LOL

I don't even mind getting a blood test. What I mind is the fact that it takes them at least two months to get test back. But they go ahead and charge you that day! So you get to be charged with DUI on the word of some dude probably barely more qualified than the average Home Depot Clerk for a minimum of 2 months and it's taken as long as 4!!!

If the cop believes he's already got the cause to bring you to jail because you won't walk on a straight line then trying to walk on a straight line is not going to get you out of it. There's literally hundreds of videos proving this point.

I should also point out that if the only reason the police officer actually arrest you and takes you to jail is because you wouldn't do his dog and pony show then that's pretty much proving the point that the police are fricking kidnapping people tying them up and putting them in a cage with no probable cause. Which of course is happening a lot but still. They could at least pretend to hide it

the blood test is your best friend, if you're sober - if you get it at the hospital, you get the test results the next day


breathalyzer too, but they'll lie to you and not show you the results

Learn to read dummy


refuse the "field sobriety test" because it's a complete clown show, and should be outlawed - all they do is say "you failed it"

ask for a breathalyzer

if they still give you shite, ask to go to the ER at that moment to get a blood test, results of which would be the next day

Why doesn’t anyone ever ask what kind of alcohol they smell? Isopropyl smells different than wine, beer, margaritas,etc.

The “general smell” of alcohol proves nothing.
