is Chris van holland in violation of the Logan act?

Key word: unauthorized

quote:

Senator Chris Van Hollen has not been formally accused or charged with violating the Logan Act. However, his recent trip to El Salvador to advocate for the release of Kilmar Ábrego García—a Maryland resident allegedly wrongfully deported—has sparked debate among political commentators and some Republican figures. ?

The Logan Act, enacted in 1799, prohibits unauthorized U.S. citizens from negotiating with foreign governments in disputes involving the United States. Although Van Hollen met with El Salvador’s Vice President Félix Ulloa during his visit, there is no indication that he engaged in unauthorized negotiations on behalf of the U.S. government. Moreover, the Logan Act has rarely been enforced, with no successful prosecutions in its history. ?

Legal experts generally view the Logan Act as a political tool rather than a practical legal instrument. Given the lack of prece cedent and the nature of Van Hollen’s actions—advocating for a constituent rather than conducting unauthorized diplomacy—it is unlikely that his trip constitutes a violation of the Logan Act. ?

Every time one of congress rolls over to Ukraine is shady Logan act behavior.

An illegal is a constituent? Like a thief in my house deserves to be fed? Can I claim him on my taxes?

There's been a lot of speculation over the years that it might not hold up constitutionally.

So let's use this guy as a test case and see what happens.

I'm not sure about that now. Did Biden give him a social security number and maybe he voted?
