Why do I get sued for a fender bender with minimal damage and no actual injury? Because the ins Co will settle is why. Atty and insurance fricks are different side to the same coin. What a fkn racket.

The "Tort reform" from 2020 was horseshite and did not address any of the cost drivers. It was watered down by JBEs ambulance chaser cronies.

Lol, the tiny percent of total claims that involve these injuries constitute only a tiny percent of total claim payouts. The problem in Louisiana is that claims can be generated out of nothing to exhaust insurance policies regardless of actual injuries. Every accident is like a scratch off lottery ticket; you just gotta scratch off that policy to reveal the policy limits, then treat long enough to force a settlement for the policy limits.

Auto insurance is up 22.2% across the country. If yours is not creeping up that fast it did something. However one bill and even four bills won’t fix the ridiculousness of LA insurance issue

I’ve told the story before of a woman I know whose daughter backed into an empty car in a gas station parking lot. Minimal damage to the parked car’s fender, no damage to her bumper. No one inside the parked car. She went inside to find the owner and they exchanged insurance information. Months later, her insurance doubles on her daughter’s car because the insurance company paid like $1,500 in auto damages and $8,000 in personal injury damages, to a person that wasn’t even in the fricking car!

My rates increased by 23% in Texas. Its fricking ridiculous. I told my 17 year old that I was considering dropping her vehicle from our insurance for the summer and we would just taxi her around.

If the insurance company doesn’t settle, and you (their insured) gets a judgment against you for more than your policy, you would then have a claim against your own insurance company for failing to settle the claim when they had an opportunity to do so. The plaintiff attorney will then offer to release you from that excess exposure in exchange for assigning your rights to them. They will then go after the insurance company for the whole judgment.
The end result is the insurance company has to weigh the risk of a Louisiana jury (who is inundated with advertisements and billboards suggesting all these claims are worth millions) awarding a lot of money and then they might have to pay that whole judgment even though their policy limits were some lesser amount.
If you want your insurance company not to settle, are you willing to release them from all liability to you for not settling in the event it goes badly for you at trial? Just because you think the person wasn’t injured (and they may, in fact, not be injured at all) doesn’t guarantee the jury will agree with you.

Several major auto insurance companies left La. last year. I lost mine. They still sell in the other 49 states. I wonder why they hate La.
