I'm not taking the side of the NFL here for any other reason than being interested in the legal debate but it seems to me that having the word "Houston" prominently displayed on the front of the jerseys UH sells should matter. That's what's missing from other schools with similar jersey colors.

This guy just lost a lawsuit to Nike for copying Jordans. It doesn't have the nike swoosh and there are subtle differences with the stitching so it's not the same right?

Yes but that could cause confusion for consumers which he is most likely trying to take advantage of for profit. A little different with UH who isn’t doing to confuse but honor the history in Houston

they kind of lost me here. Other than a some shade of a powder blue jersey, these uniforms look nothing like the Houston alternates

The Houston alts don’t really look like the Oilers unis either. That’s why they brought them up. It’s a color scheme. The NFL doesn’t own the rights to generic stripes or random color combos.

What this case is similar to, is like a college team selling jerseys in the bookstore… and the players wanting profit off of their likenesses even if it’s not expressly them

Like when Burrow played at LSU… if you bought a #9 jersey it could be for any player that had ever worn #9 (there weren’t any names on the back), but the NIL proponents were arguing that if you bought #9 it must have been for Burrow and he deserved a cut of the purchase price

They really dont if you side by side them. It’s a just color scheme. That blue isn’t even original to the Oilers b/c they got it from the city of Houston’s official flag.

Hattiesburg high school had the exact same logo as lsu except HHS instead of lsu. Tiger logo same.

Houston designed those uniforms like they did on purpose to mimic the Houston Oilers

Of course they did! But the question is whether the NFL (and a franchise in Tennessee) can prevent a university in Texas from wearing uniforms that look similar, though not identical, when those uniforms don't feature a single NFL/Oilers/Titans trademark. Only similar colors and (less) similar stripe pattern.

There also could be an argument of selective outrage. The Colts and Duke don't have "similar" uniforms. They have identical uniforms. Perhaps Duke has permission from the Colts to have that style of uniform. If not, did the NFL prosecute Duke for trademark infringement? Did they do so when Memphis copied the Bengals helmet design?

Both sides have good arguments. I just like the pettiness of the fight.

It's the University of Houston, on behalf of the City of Houston, giving the bird to the Adamses

So does Lutcher High.

There's supposedly a program where a high school can pay $1 a year to imitate a college or pro team.

Iowa, for instance, has almost the same uniforms as the Pittsburg Steelers, but they got permission in the 70s to do what they did from the Steelers.

And it was bullshite then that they had to. Do the Pittsburgh Steelers own the colors of Black & Gold? No, they don’t.

I don't think the NFL is actually going to fight it...which is why the AD is so bold in telling the NFL/Titans to "bring it on!"

It’s a win/win for Houston. If they win, then the school keeps some pretty sweet alt unis. If they lose, then the city of Houston has another reason to hate the Adams’ even more than they already do.

Ron White had a great routine talking about the lowest form of life out there, including his ex wife, her lawyer, and his own lawyer.

“And here at the bottom, we have Bud Adams! Whatcha doing here, Bud?”

Anyone confusing the Houston Cougars for an NFL team would be sadly mistaken.

Much like the final years of the Oilers in Houston TBH.

My late stepmother, who taught at Hattiesburg High for around 30 something years, told me that it was a football coach there who had attended LSU who matched up the uniform style for football.

Rummel had very similar jerseys when I was there. They gonna sue them too?

Not sure if still the case but when I was in HS, we just paid like a dollar or a ceremonial yearly fee to the college we used as a logo, so they could enforce the trademark elsewhere still without needing to be a Dbag to high school coaches/players

In this case the NFL sees real dollars funneling into Houston and want a piece of the pie. Really silly and I feel like a total loser of a case outside of just legal / financial pressure that the league can put on. No chance that would cause consumer confusion or negatively impact the brand of the “Oilers” which isn’t even the active main brand of the organization.

If anything the Tennessee oilers existing is causing the consumer confusion

UH would win that case. You can't lay claim to a color scheme.

NFL is going to back down though. That team is defunct anyway.

Am I right in saying that the nfl (or the Adams family) screwed themselves in this situation?

If the Texans were able to keep the Oilers colors/logo/name etc, I bet Houston wouldn’t even have tried this ‘stunt’

Tilman Fertitta has F You money to fight this for UH. He will just tie it up legally. Good try NFL.
