If you are a Textualist, you must agree. Amendment 14, Section 3 DOES NOT specifically require a "conviction." Of course, it is ALSO silent as to how participation in an "insurrection" might be determined or adjudicated.

So, how would it work? We don't know, but can draw some inferences.

States choose their electors. Thus, the actual election would probably proceed as normal. There is certainly nothing in the 14th Amendment that would bar Trump from "running" or bar states from putting his name on their ballots. Of course, individual states might seek to exclude him from their ballots.

If he were to be selected by the Electoral College, we might well see Congress decline to certify that election, if Congress were then to determine that he participated in an "insurrection." Yes, that is clunky and inefficient, but textually it seems to make sense.

Best guess, anyway.

For anyone who thinks this can't happen because it seems so far fetched, just wait. They could railroad this right up our asses and the people you elected to represent YOUR interests probably won't say shite.

Trump has been indicted 4 times, which if you believe the mainstream media, was completely bipartisan and was totally justified. They'd also say enforcing the 14th Amendment is just as warranted and will parrot anything the dems want them to say.

This could very well happen and I can totally see it being possible. Anyone who thinks it isn't hasn't been paying attention.
