If you can't tell the difference between me going 60 and a stopped car maybe you should be the one that pulls over to the side of the road.

I agree that it is unsafe, illegal in many states (not all), and recommended against in the others. But, this always confuses me

The fact that you are getting closer to the vehicle with the hazards on should be the first clue that they are either stopped or driving extremely slow. If you are driving at a safe speed and not catching up to the hazards should clue you in that it's just an idiot driving with their hazards on proceed with caution
