You failed this morning. You will just need to accept this fact.

The officer was correct in his assessment and cited you for the infractions.

Be an adult and accept accountability. Pay for your error and get up earlier. Stop using your cell phone while driving. Running red lights are dangerous and cause many accidents.

Now move along with your day and make better choices.

I was running a bit late on my lunch break so I decided to just take my food and walk out without paying because the line clearly would have taken three more minutes.

Don't be an immature a-hole. How old are you? The law doesn't just apply to texting on your phone. take responsibility and learn from your mistake.

What's the difference between texting and being on YouTube. They both are equally distracting. Put the phone down and drive

He gave me two tickets. One for failure to obide to traffic control devices and one for failure to use due care. My question is, can I get out of the failure to use due care one? I never admitted to using my cell phone. I don't think there's any way he can prove it either. Also I hadn't texted anyone at all this morning.

Are you serious? You think anytime someone doesn't admit to speeding, running a stop sign, failing to use a blinker, running a traffic light, or any number of other traffic violations they just throw the ticket out? Their proof is the cop saw you run the light and he saw you looking at your phone.

Did you have the phone in your hand? Or was tr phone on your console and you used a finger to push next?

It seems to me that you must have been looking down when you ran the light (and may or may not have had phone in hand as well). To me thats the only way for him to conclude you were using your phone.

Go talk to the prosecutor. Explain and offer to plea to one if they will drop the other. They are both moving violations so they probably will say ok.

That's using your cell phone, dumb arse.

How is changing music on a cell phone different from changing music on a radio screen? Why is one "specifically" illegal and the other only possibly deemed distracted driving. Before you go that route, I understand that both are distracting actions but why the frick do we need a law specifically for cell phones. What if I had my laptop on the passenger seat and was typing an email?

I understand what you're saying.

I guess that's not what I'm arguing though. He used my "use of cell phone" as reason for my "running the red light". Like I wasnt using due care because of cell phone use.

For those others asking. I didn't run a blatant red light, it was yellow and I knew it was about to turn red.

Glad to know the law only applies when it doesn't inconvenience you.

Officer's word tends to win in cases like this. He may also have a camera mounted on his car that caught you going through the light while you were playing with your phone. Pay the tickets and deal with it
