The law in Ga is no cellphones at all for any reason. Even if you're sitting at a red light.

Barely missed it. I know that the light for the other traffic was still red. I wouldn't have been blocking an intersection and I didn't put anyone's life in danger. I would have pulled myself over as well.

I run red lights all the time. If it's early in the morning or late at night and I approach an empty intersection, I'll stop, look in all directions, and the proceed through the intersection if its clear.

The whole purpose of a red light is to prevent collisions at intersections and if you treat it like a stop sign on a empty road, then it's fulfilled its purpose.

I understand their necessity at peak traffic times but they really should flash red/yellow at low traffic hours - especially in a place like BR where our local government's only "solution" to intersectional traffic is to throw up another red light.

As for the OP, you violated both statutes so there is no arguing your way out of it. Contact the prosecutor in charge of traffic and try to get a deal.

Do yourself a favor. Hire a traffic attorney and have the charges reduced to nonmoving violations. 99% of the time they don't care what you did, they just want your money.

My experience both in NY and in LA has been they don't care if you broke the law. They just want your money. Simply say you'll pay an equivalent fine for a nonmoving violation and you plead guilty, and they don't care.

But isn't it still "distracted driving"?

What if I'm taking a photo of myself with my DSLR while driving? Is that legal? What if I'm reading a damn paperback book? Is that different than reading a text?

I've been asking this question for many years. I see cops watch laws, especially traffic laws, being broken very often and nothing is done. I'd like a list of the ones that are ok to break. Might be fun sometimes.

Stop being ridiculous. There are tons of cases where cell phones have been the reasons for car accidents. If we had a bunch of people taking selfies with a DSLR and causing accidents then I'm sure it would be addressed. Cell Phones are clearly huge distractions.

Americans are checking their smartphones roughly 1 billion times more a day now than they were a year ago, according to Deloitte’s Global Mobile Consumer Survey.

Simply put, people have a very hard time disconnecting from their phones, and that doesn't change while driving.

Dude, what world do you live in where you think everybody should abide by every law?

Do you regularly break laws?

I wasn't harming anyone. I have been through that light 1,000 times. I understand how it works. I was going maximum of 8mph while driving through. No one's life was in danger. In terms of the cell phone... I wasn't texting and having to look down to see if i was typing the right words or anything. I was looking at the next video suggestion on youtube, stopped to look at the traffic situation (while still having my phone up), and proceeded through.

Not sure about GA, but in LA they define the law to include everything under the sun concerning cell phone use in cars. It isn't just texting.

So while you weren't texting and your cell phone records would prove that, you'd probably have difficulty proving that you weren't on YouTube
