It is my understanding that refusing a breathalyzer is grounds for an arrest or suspension of your license in most jurisdictions. They pulled him over because he not only didn't switch lanes away from a cop on the side of the road he actually switched into the lane to pass next to the cop.
Plus this is the same POS who left his friend paralyzed for life after driving like an idiot and crashing his car nearly 20 years ago.

Not sure if this is the guy I would choose to defend or the arrest I would be up in arms about.

There is zero reason to ever agree to a field test. If they want to arrest you, they will. All you're going to do is incriminate yourself.

And it's incredibly easy to beat in court.
You're going to jail one way or the other...that was decided as soon as the cop lit him up.

Yep and the tests are up to officers discretion and they are designed for even sober people to fail. Nothing good ever come of taking a field test.

I literally was on the receiving end of one of these back in the late 80s.
I was driving for a bachelor party and had maybe two beers in 3 hours. When a cop went by us at a stop sign the guys in the SUV we were in kind of started freaking out, I guess they thought I had more to drink than I did.
The guy followed us for several blocks and when I parked on the wrong side of the road he turned his lights on. I should note I was also on crutches and could do the walking part of the sobriety test. And very few people can adequately complete the eye portion of the test without giving them a reason to test you.
So he took me down to the station which was a couple of blocks away, we were in downtown Lafayette. Gave me the breath test there and I think I blew less than .02. On our way out we passed a cop coming in with a kid I knew who was doing the drunk shuffle, barely getting his feet off the ground. The other cop said "Got another one?" to which my guy stated, "Nope, bad call".
When we got back to our car he reprimanded those other guys for acting like idiots, I think he was pissed he wasted his time, he did tell me he was sorry though.
The fact was, we were going to the guys house to get an ice chest to buy beer and drive to New Orleans so who knows what kid of trouble that cop saved us from

I was watching a YT channel recently and they were administering the roadside drunk test to someone. I was completely sober and decided to follow along just to see how I did. My first try at all the tests I have zero doubt the cop could have failed me for not exactly following the rules. Now I get it most people who fail can barely stand up and it’s obvious they’re wasted but Hogan’s son did every bit as good on the tests as sober me did. So I lean towards the belief that all a sober person can do during these tests is incriminate themselves.

Cops showed up to the house we were at and just opened the door and came right in without knocking and no warrant.
I told one of the cops that I wasn't drinking and offered to take the breathalyzer, but he wouldn't let me. Then he proceeded to do the field tests and told me I failed them.
Since I wasn't driving, the Sherrif told him to write me up for Contributing to the Delinquency of Minors. They wrote me a citation and then told me to go home.
I had to hire an attorney and go to court 6 times before the judge finally dismissed the case.
Between shite like that and having to deal with small town cops pulling us over (without being able to tell us why) and illegally searching us and the vehicles, I've had a strong distrust for the police for most of my life.

Update: Hogan's kid has waived his right to a speedy trial and has his next hearing on 2-23.

How fricked up are we now?
I saw this the other day and don't feel like watching it again, but from what I saw Hulk was extremely polite and professional throughout the entire encounter. I don't think he tried to help his son out any more than any other dad would.
On the other hand, Nick was probably loaded.
