For the sake of argument: The charge would be driving under the influence or impaired driving. If the roadside sobriety tests showed he was not impaired, what do the results of any other testing matter?

I would think an alcoholic or other substance addict can operate normally even beyond the legal limits of those substances. Where is the evidence his driving was impaired?

Never, under any circumstances, do any sobriety test that cops offer you.

Don’t do the field sobriety test. Don’t do the breathalyzer. Refuse the blood draw. Urine sample.

Refuse them all.

The cop already has it in his mind that you’re guilty the second he pulls you over and when you do those things you’re just giving him and the state extra ammo.

I’d be curious to know the percentage of people that do the sobriety tests and “pass” and are let go? Gotta be under 10%

I can't speak for everyone but I've had two field sobriety test. I drove home after both. Granted I wasn't trashed but had drunk a couple beers both times.

My SIL is a lawyer(not criminal)and she always claims to refuse field test and ask for breath instead. Her reasoning was field test are subject to officers decision. Breath was scientific yes or no.

One part of the test was a bitch, stand on one foot point the toes of the raised foot forward and alternate your arms touching your nose. Lost my balance just slightly and wobbled a little but recovered. He probably could of been a arse about that.

Cops are thought to profile like this.

Also, if you are driving with your lights off, they automatically assume you have been drinking.

Cops aren't pulling you over for your lights off or expired tags or a burned out taillight. That's just to get you pulled over. They are ALWAYS looking for something else to bust you for. Always

I have cop friends they tell me how they operate.

Speaking of cops maybe not always doing the right thing (although this one is questionable) has anyone watched American Nightmare on Netflix?

4 years ago my friends and I were out drinking and I was drinking all night while my friend was supposed to be DD. Well before we left he did some coke with some random guys and got sick so couldn't drive anymore. I decided I'd be fine to drive the 5 minutes back to our apartment. Obviously not a smart decision, and his car was loud so anytime you hit the gas it would sound like you were speeding.

Long story short, I got pulled over and had to walk the line and follow his finger and the cop said "Good enough", scariest moment of my life because it could have ruined my future and was a dumb decision. We drove slowly home, but once we got to the apartment we partied the rest of the night and was grateful I was lucky and haven't driven after a few beers since

Glad I was in that 10%

I've had them pull me over before for lights that are out that weren't actually out. Thankfully I was sober but they certainly tried their best to call me drunk

I will say I know what and why attorneys advise but that also happens to make them money. I think if you are truly completely sober there's no harm in blowing. But only completely sober.

Field sobriety is a whole different ball of wax and I don't blame anyone for refusing but two different times I've been asked to blow and do field sobriety when totally sober and I have and I was let go

It's bullshite but it is what it is

If you know you are good and still blow 0.00 on the breathalyzer they’ll just say you are high and arrest you anyway. Then finally after blood work shows no traces of anything they’ll drop charges. But still shows up as arrest. They can ruin your life for nothing

I did watch, and was disappointed as it wasn’t about Cody Rhodes.
