Can those THC seltzers cause you to get in trouble with your employer?

Rouses sells a lot of those things legally, but I don’t know if I should drink them because I’m subject to drug testing at work. Do Louisiana employeers make exceptions for that now or will you get in trouble still for something perfectly legal?

If you're asking if you will test positive, 100%. It's the same THC that is in legal marijuana. Whether or not your company will act on it depends on what the policies are. Our company doesn't give a shite about that because they know they'd have to fire probably 75% of the company.

As for the drinks themselves, yes they will get you very high if you have a low tolerance.

I'm sure every company policy is different. Talk to your HR department. I've heard Marathon Oil refinery no longer tests for THC. I think my company allows it with a prescription. The landscape is changing with more and more states making it legal. I know there are now drug tests that can tell if you're currently intoxicated (like a breathalyzer) and some places are utilizing those testing procedures. I can see the logic there. If I partake of some THC on a Friday or Saturday night there's no reason I can't do my job safely on Monday morning IMO.

It is company specific.

I lost a great employee with no priors who popped THC. HR did not care that you could ingest it legally now.

“Can do the same with alcohol”

“Yes, but you don’t test if they had any in the past week or longer, yes/no, like with THC. You are actively testing for having enough in your system for impairment right now.”

“Doesn’t matter, it’s policy.”

shite company, that I’m now actively looking to leave.


But to answer the question, it’s as individual as the company. Some are hardliners like mine. Some might be middle of the ground and consider local availability and legality. And others took it off their test panel entirely just to avoid the situation all together.

Part of it has to do with insurance too. In the past alot of workers' comp insurers would give pretty hefty discounts if you had a 0 tolerance drug policy in place. That is changing a bit now obviously.

Where i work they only piss test if you get hurt or break something expensive. They quit doing randoms a long time ago.

Would really depend on your company policy.


At my employer our policy states the substance has to be
1.) legally obtained
2.) legal substance in Louisiana
3.) Taken in accordance of a doctor
4,) can’t be on the substance while at work.

So according to this I can take THC gummies and drink that THC seltzer, just not before going to work. I mean it’s a legal substance in the state so it’s no different than alcohol. You can buy them both at a gas station.

In 2018 a federal law was passed that allows certain hemp derived products to be legally sold. Most of the THC products on the market now in states that are not recreationally legal have hemp derived delta9. For all intents, it's the same thing as regular THC.

Because unlike what is said earlier in the thread, it’s not the same THC. Delta-9-THC, the primary psychoactive compound in weed, is heavily regulated.

Delta-8-THC, which is less potent and is also present in hemp, is currently unregulated in many jurisdictions unless laws were passed specifically to kill it.

The issue is though that test isn’t indicating that you took those this morning or even last night.

You having had a THC seltzer and a gummy last weekend would show the same result.

This is a fuzzy one to me. Joe forklift operator runs over a coworker because he ate a THC gummy at lunch. Urine drug screen is irrelevant because per the policy it is ok as long as he meets the first 3 item. How do you prove/disprove THC intoxication? If he is habitually using at work it is creating a dangerous work environment for everyone but you can't justifiably fire him
