You likely lose out on some of the legitimate lawsuits since no lawyer is going to want to risk financial penalty.

While I agree with the sentiment, you lost the plot. Being lactose intolerant has nothing to do with being fat and expecting the world to accommodate you. The first part made sense within the OP discussion, the second part is just you ranting.

That said, this lawsuit is bullshite. You order a drink with a more expensive substitute and expect it to be cheaper? No, that ain't how it works.

I have noticed recently that if I get the coffee with regular cream its cheaper but I sort of expect it to be. No issues with me.

Typical socialist, collectivist mindset. They know that the alternatives to regular milk cost more and that Dunkin won't eat those costs themselves. They're suing to force Dunkin to spread the loss over ALL customers, not just the ones causing the loss.

I'm allergic to low grade beef so I require my restaurants to serve me ribeyes at the same price, or else I'll sue!

I would argue that they make a decision to get their coffee from Dunkin knowing that it charges for non-dairy alternatives.

Does anyone know if it cost more in the grocery store of non-dairy alternatives? Because if thats the case, a lawsuit like this could open the doors for people suing everywhere in which non-dairy alternatives cost more.

Will be thrown out because of this. Things that cost the business more get passed down to consumer. Or business is hurt. Absurd they think this case has a chance.

There needs to be consequences for frivolous lawsuits.

I'd be fine with being fined a large percentage of the damages asked for.

Dunkin can sue for legal fees and I imagine Dunkin doesn't use cheap lawyers.

Problem is you can't get blood from a stone, so I'm sure these people have nothing to lose.

The real punishment needs to be for the attorneys that do this. Disbar them. That'll stop it.

Yes, non-dairy usually costs more than dairy

Dunkin should raise the price on their milk to be equal to the non-dairy milk alternatives and problem solved. And if anyone complains just let them know they are being insensitive to those who can't have dairy.

Will be thrown out regardless.

Being lactose intolerant does not qualify as an ADA disability and therefore is not considered a protected class.

Duncan Donuts, a private business, can charge whatever they want and need not provide any explanation or justification when doing so.
