TERRYTOWN, La. (WVUE) - A 10-year-old boy attempting to cross a state highway with a group of other children Friday night (April 18) was struck and killed by a motorist, Louisiana State Police said.

The victim was identified as Kevin Madrid of Terrytown.

State Police said Madrid was with a group of unsupervised children attempting to cross Louisiana Hwy. 428 (Behrman Highway) near Nile Street around 8:30 p.m. Madrid was the only child who didn’t make it across, as he was struck by a 2012 BMW 750i that was traveling east on the highway.

“For reasons still under investigation, Madrid and the other children entered the eastbound lane of LA 428, in an area without a designated crosswalk, and crossed directly in front of the BMW’s path,” an LSP spokesman said in a statement. “As a result, Madrid was struck by the BMW, suffered severe injuries and was transported to a local hospital, where he later died. No other children in the group were struck.”

Authorities said the driver of the BMW was wearing a seat belt and was not injured. The driver remained on scene, showed no signs of impairment, and voluntarily provided a breath sample “which showed a result under the legal limit,” the LSP said.

The fatal accident remains under investigation.

Agree.

I don't know that I've ever seen so much description.

Guy should've lawyered up ASAP.

For what? Unless they somehow determine negligence, wouldn’t this just be chalked up as an unfortunate accident in which he wasn’t at fault?

That’s awful. I remember walking down Old Hammond Hwy in 3rd grade to go to 7-11. And going all over. Of course that was so many years ago.

He did nothing wrong.

No reason for his car description to be released nor the subtle bullshite, cop comments.

Feel bad for the family and the driver (as long as it’s proven he is innocent). Sad situation.

Waffle House is right there at the corner of Nile and Behrman, so the kids may have been going for a late night snack.

He volunteerd for it, so he was confident he'd pass.

That's awful trusting of those raggedy-arse, portable units.

I find that weirdly worded. It sounds like he had alcohol in his system, just under the limit?
Or, do they just say this bureaucratically any time you are "under the limit" even if there's zero alcohol in your system?

Seems clear that he had an alcohol level that was below the legal limit.

It absolutely is, and opens the door wider for civil litigation.

Unsupervised 10 year old is the issue.

Probably easily avoidable with additional lighting, crosswalks, etc.

Stuff Louisiana is lacking.
