SCOTUS isn’t going to mess with immunity

If they would that would mean impeachment, which is the current process for charging presidents would be voided. Any DA/state could indict a president and force a trial. This would blow up the way presidents are dealt with by Congress. Biden could be indicted by a red state DA right now and be forced to stand trial while in office .

Whether or not immunity exists isn’t the question. The limits of that immunity is what the Court has to parse out.

Correct. Which I previously believed was common sense, seeing as that distinction is present in every other type of legal immunity for public employees/officials in the entire body of law of the United States.
The issue has always been whether whatever actions Smith is relying on are within POTUS’s official duties.

No it wouldn’t. Impeachment and legal proceedings have zero connection in any way. Neither has any relation whatsoever to the other.

List all the presidents and judges that have been criminally prosecuted for doing what Trump has done. This has little to do with presidential immunity and everything to do with that

Trump was not convicted by the Senate. If he had been, he would have been removed from office.
