Weaponizing the First Amendment: How Free Speech Became a Conservative Cudgel

The two decisions were the latest in a stunning run of victories for a conservative agenda that has increasingly been built on the foundation of free speech. Conservative groups, borrowing and building on arguments developed by liberals, have used the First Amendment to justify unlimited campaign spending, discrimination against gay couples and attacks on the regulation of tobacco, pharmaceuticals and guns.

“When I was younger, I had more of the standard liberal view of civil liberties,” said Louis Michael Seidman, a law professor at Georgetown. “And I’ve gradually changed my mind about it. What I have come to see is that it’s a mistake to think of free speech as an effective means to accomplish a more just society.”

To the contrary, free speech reinforces and amplifies injustice, Catharine A. MacKinnon, a law professor at the University of Michigan, wrote in “The Free Speech Century,” a collection of essays to be published this year.

“Once a defense of the powerless, the First Amendment over the last hundred years has mainly become a weapon of the powerful,” she wrote. “Legally, what was, toward the beginning of the 20th century, a shield for radicals, artists and activists, socialists and pacifists, the excluded and the dispossessed, has become a sword for authoritarians, racists and misogynists, Nazis and Klansmen, pornographers and corporations buying elections.”

At this point let Your Humble Pimpness briefly interject to

quote:

The Supreme Court has agreed to hear a larger share of First Amendment cases concerning conservative speech than earlier courts had, according to the study prepared for The Times. And it has ruled in favor of conservative speech at a higher rate than liberal speech as compared to earlier courts.

Got that. It's not Free Speech. It's magically become something called "Conservative speech" which the former newspaper NYT assures us is dastardly. And we should all be concerned about all this "Conservative speech", which as you know is far different from the more Correct Liberal Speech, which is they assure us, the real Free Speech.

So to recap: A former newspaper says Free Speech by liberals is essential to justice and Free Speech by Conservatives is a bludgeon or club of injustice.

This is dangerous, and it’s a direct result of the left creating a category of speech called “hate speech”.

Now that they’ve defined the category and demonized it, they can move any kind of speech they don’t agree with into that category.

Has anyone been imprisoned by the government for something they've said or written? Did I miss something?

You have liberal academics who fought for free speech in the 1960's and 1970's now stating that it's a danger when conservative viewpoints are being defended by the Court. This is viewpoint discrimination and precisely why the Supreme Court is so important. If it were up to American liberals, we'd have speech codes more draconian and authoritarian than those in the U.K.

Had these quotes come from your average naive SJW, it would be laughable.

But coming from instructors at 2 of the best law schools in the country, it’s infuriating, terrifying, and baffling that one can be intelligent enough to reach the positions that these two hold but also at the same absolutely fricking retarded.

Maybe we got rid of McCarthy too quickly.

Can regressives make a logical argument without adding..

It's obvious their position is weak, so they use the same BS names over and over.

This is a classic leftist move.

When something turns against you, redefine it.

How do people with law degrees say something like this?

If I went to the local university and typed in 'first amendment' to the library search, I could go pull an entire cart of books off the shelf in ten minutes and each one would completely disagree with that. I can't even imagine how many state, federal, and scotus cases could be pulled to contradict it as well.

That is pure insanity.

shite is incredible. A basic tenet of classical liberalism has been castigated as a conservative cudgel by lunatic leftists.

Weaponized speech? .

shite like this is why Trump won. Liberals are their own worst enemy. They love to play two games; the victim olympics and the Nuremberg anti-conservative trials.

I really wish the daily wire would let you pay for the shows individually. I have no use for Shapiro’s podcast but Andrew Klavan is great. He makes my day better. Hell, I like Michael Knowles show a lot as well.

There's a reason it's the FIRST amendment. It's absolutely the most important tenant of our society. If the 1st amendment goes you can call it a day, America is done, and that's not hyperbole.

The fact that everyone doesn't recognize this is alarming.

Abolishing the first amendment (directly or indirectly) would cause more of a civil war than abolishing the 2nd IMO.

If the left really got their wish and started regulating everyone's lives, where could I go if I still wanted freedom?
