Who was responsible for the prop being a real gun?

A number of people including, at least according to this grand jury, Alec Baldwin.

Manslaughter or involuntary manslaughter? Though granted, I am not familiar with the New Mexico statutes on each crime. If they even are separate crimes.

While that is definitely an aspect, he also broke other safety protocols:
1. They were not filming a scene, so there is no reason to point a gun at the person nor pull the trigger
2. He did not double check the weapon
Brandon Lee died from an squib load. Just because a weapon is setup for fake ammo doesn't always ensure safety.
Baldwin should shoulder some responsibility.

He forgot ABC… Always Be Checking the chamber.

The arms person on the set and Baldwin himself.

I'm actually so what split on this. While I loathe Baldwin as a person and this shite is fitting for him to go down this way, but I honestly want to know how some moron actor who has no idea about firearms and firearms training is supposed to even know to check his weapon.
That is 100% on the armorer. Not the actor. Once the actor is handed a weapon, it should be safe and clear to use.
Also, why is there even a live round anywhere near that set? That's also all on the set armorer. This is all on them. Not some idiot phag who has no clue about guns.
That is my objective take.
Now.... If he had extensive firearms training, then he may bear some responsibility. But I still feel it's 100% on the dipshit who gave him a hot weapon.

I agree with you. I hate Alec Baldwin but how frickin hard is it for the armorer to not have live rounds on a gun? I mean damn

Also how the actor from:
and...
Died...gunshot to the head...not understanding a blank cartridge is actually still a projectile.

these actor go through all sorts of training for every role they play.
whether it's some form of martial arts, fencing, dancing, etc.
so I'm under a pretty strong assumption that firearm training is also something that they go through.

For a major production? Yes.
For a little fly by night indie production where Baldwin was one of the producers? They didn’t make him do it because he said he didn’t need to.

He cut corners on safety measures to save money. It’s 100% his responsibility.

I'm fairly certain that Baldwin has been involved in numerous major productions where his character used a firearm. He should have known better about gun safety, especially with him being a producer on the film.

I'm not sure why they put firing pins into... nevermind.

The arguments here are much better and more rational than the ones previously on the OT about this. Some idiots think he should go to prison for murder. Some say he even killed her intentionally.
I don’t know Baldwin but I’m pretty sure I would hate him personally. But that doesn’t mean I can’t look at this rationally and come to the conclusion that he shouldn’t be criminally responsible for her death. If he’s found monetarily liable in some way since he was the producer or cut corners or whatever, I’m good with that. That seems fair to me. Hell I’m even good with him never working with firearms again, or even his career being ruined (however much so). I just don’t think he should go to prison for what seems to pretty obviously be an unintentional accident. Although I also admit I don’t know every single detail about this either, so maybe there are some things that would change my view on that. Who knows.

A movie set does not exclude someone from the laws of the jurisdiction that the set operates in. Here’s what the state needs to prove Baldwin guilty beyond a reasonable doubt of involuntary manslaughter:
1. Baldwin performed an act that could result in the death of someone ( he pointed a gun at someone with his finger on the trigger.)
2. Baldwin KNEW that his actions are inherently dangerous
3. Baldwin acted with a willful disregard of others
4. His act caused the death of someone
5. The crime happened in New Mexico
Points 1, 4, and 5 are slam dunks for the state - I don’t think there’s any disagreement between parties on those points.
Point 2 Baldwin will try to fight, but he’s not credible - already admitted in an interview that he would never point a loaded gun at someone because that would be dangerous. So, if he knew it dangerous, why didn’t he take extra steps to make sure it wasn’t loaded? . Also, he’s a gun control advocate and his dad was shooting instructor. Not many people can plead ignorance that a gun is an inherently dangerous object and extraordinary care must be taken when handling
Point 3 is where the legal battle will be. We already know Baldwin is trying to blame the prop masters, but the state has a lot of ammo with him being the producer, how he was going ad hoc without the armorer present, not taking other precautions such as remote cameras or shields to protect the woman killed. I’m sure the state will call actors/witnesses that detail how these things happened in Baldwin’s other movies.
