Who is best disability lawyer in Baton Rouge?

Wife(no pics) has rods and screws from neck to arse. She needs to draw disability if possible. Give me some advice you baws.

Has she applied? It takes a while for them to make determination but you do get back pay.

No lawyer is going to fool with unless an 18 wheeler caused her to need those rods and screws. If so, they will be tripping over themselves to get her case.

There are lawyers and law firms that specialize in disability like the OPs wife

Go to the Social Security website and apply online for disability. That will get the process started. There are some other things that will need to happen which involve extensive medical records and probably a trip to a disability determination doctor.

She will be denied the application. That’s when you contact an attorney. The attorney can’t do anything you can’t do for the initial application. They are more useful to appeal. Almost everyone who applies (with the exception of people requiring kidney dialysis and a couple other specific diagnoses) is denied on initial application. They will deny it but I’m convinced that’s their way of weeding out people. Only the ones who will follow through with an appeal get their disability.

The good news is it will be retroactive- at least to the application date but typically to the date the disability was significant enough to be a qualifying condition.

They will help her. It is important to go ahead and apply as soon as possible. It will take for ever. Most people get denied then you appeal and then go to court. The attorney always gets like 10 percent of her lump sum payment which will be for the time she was not able to work and when the court decides (in retro).

Assuming you are referring to SS disability. There are three steps:

1. Initial Claim - medical records are gathered and possibly consultative exams are set ups. A doctor, employed by the state, makes a decision. 70% are denied at this stage and a decision takes 4-8 months.

2. Reconsideration stage - A different doctor reviews the initial claim and makes a new decision. 99% of the time the initial decision is upheld (unless there is new medical). Takes 2-3 months.

3. Hearing - most people get approved here, this is the stage you want to consult with an authorized rep. Most reps don't do much, 1 out of 5 are actually helpful. Ask people in your local area who they used, the rep takes a % of the back pay up to $6k (they can file a fee petition for more). Don't use someone who advertises heavily, they are going on a volume game. A decision takes 1 - 1 1/2 years.

Have her open a myssa account and start her claim online. She can not be working at all.
